Your Agreement with Texo Terra Contracting Ltd. Terms of Service Snow clearing refers to the process of blowing snow from a designated area to an adjacent permissible area. Services such as stacking or hauling snow, as well as sanding, salting, de-icing, or manual shoveling, are not covered under this agreement unless explicitly stated. Snow clearing will begin once there is an accumulation of approximately five centimeters (5 cm) or more. This includes follow-up visits after municipal and sidewalk plowing, as well as additional cleanings during extended heavy snowfall. The timing of these services may vary with each storm. The Contractor is authorized to remove snow from your property at any time. If there isn’t enough space for snow storage on the client’s property, either at the start of the season or as it progresses, the client agrees to allow the Contractor to utilize space on the side of the driveway or to coordinate alternative snow storage arrangements with a neighboring property.
This contract is effective from November 1st to April 1st for the specified season, or until a total snow accumulation of 300 cm (10 ft) is reached. If vehicles are parked in the driveway when snow clearing is scheduled, only the areas accessible to the street will be cleared.
The Contractor will not be liable for any damage to items in the designated snow removal area, which includes but is not limited to basketball nets, garbage cans, recycling bins, plant pots, toys, hockey sticks, extension cords, and Christmas lights. Clients are advised to remove all personal items from the driveway before each snowstorm. Basketball nets should be turned or raised to a height of at least 10 feet to ensure sufficient clearance for the equipment. Additionally, please remove gutter downpipe extensions before the winter season begins. Any elevated water main caps in driveways should be leveled with the surrounding surface, which the client can either do themselves or request assistance from us or the city.
The Contractor is not liable for personal injuries or slip-and-fall incidents. Texo Terra Contracting Ltd. is solely responsible for snow removal and does not guarantee a safe or slip-free surface. By opting for this service, I WAIVE, RELEASE, AND DISCHARGE Texo Terra Contracting Ltd. and its directors, officers, employees, representatives, and agents from any and all liability, including but not limited to claims arising from negligence or fault. This includes any potential disability, personal injury, property damage, or related actions that may occur. I also AGREE TO INDEMNIFY, HOLD HARMLESS, AND NOT PURSUE any legal action against Texo Terra Contracting Ltd. for any liabilities or claims.
The Contractor will place two border markers on the street side of the driveway before the snow removal season begins. It is the client’s responsibility to provide and install additional markers around immovable objects, such as retaining walls, steps, elevated patio stones, and wheelchair ramps, which may become obscured by snow. The Contractor is not liable for any scratches, rust marks, or damage to heaved, chipped, or uneven asphalt or interlock surfaces. Additionally, the Contractor will not be responsible for any damages resulting from icy or slippery conditions.
This service does not include clearing snow that accumulates due to roof cleaning, drifting snow, or ice removal from walkways caused by freezing rain, sleet, or compacted snow. Additionally, shoveling snow in areas where equipment cannot reach, such as in front of garage doors and on front steps or walkways, is not part of the standard driveway cleaning service.
If the client fails to make any payments or breaches any of the terms outlined in this agreement, the contract will be considered null and void, releasing the Contractor from all obligations and responsibilities, including the provision of further services. However, if the Contractor is found to have violated any of the conditions, the client has the right to cancel the contract and receive a refund for any prepaid amounts. In the event of the sale or re-occupation of the client's home, the contract will not be canceled or refunded, but it may be transferred to the new occupants or to a different location, provided it falls within the Contractor's service area.
